Below you will find a top level summary of the presented OPT OUT proposal by the START Movement to the City of Arlington in April of 2019. This proposal allows neighborhoods that do not want STRs to petition for STR Exclusion Rezoning - this is similar to the effective and popular plan used in Galveston, TX for over 4 years. This plan does not ban hundreds of responsible short term rental owners with no complaints, and would thwart a lengthy and costly legal fight that will put Arlington STRs and neighborhoods in limbo.

    OPT OUT Proposal Summary

    for Arlington, TX


    Neighborhood STR Opt Out Plan

    • Prohibits short term rentals where a vast majority of neighborhoods don't want them
    • Similar to effective and popular plan used in Galveston, TX for over 4 years
    • Implements reasonable regulations to minimize neighborhood disruptions
    • Facilitates code enforcement to effectively deal with violations

    STR Exclusion Rezoning Procedure

    • 75 percent of the property owners can petition to rezone to RX
    • 75 percent of the homes in proposed zoning area must be single-family owner occupied
    • Gerrymandering explicitly prohibited
    • Commercial uses and non-owner occupied short term rentals prohibited in RX zones
    • Existing short term rentals must cease non-owner occupied STR operations within 6 months of RX rezoning going into effect

    Requirements for Non-Exclusion Zone STRs

    • Operating Permit
    • Register and pay HOT
    • 24/7 contact

    STR Restrictions

    • Operating in RX Zone as a non-owner occupied STR prohibited
    • Occupancy – the greater of
      • 2 people per BR +2; excluding children under 2
      • 1 person/200SF
    • Parking
      • 1 vehicle/2 allowable guests
      • Max = vehicles able to fit on property or on street within extended property lines
    • Noise and Trash – adhere to all applicable Arlington statutes
    • Events prohibited

    Penalties

    • Violations punishable by fines up to $2,000
    • 12 month suspension for
      • Operating without a permit
      • 2 or more citations/violations over rolling 12 month period

    Benefits of Opt Out Plan

      • Prevents lengthy and costly legal fight that will put Arlington STRs and neighborhoods in limbo
      • Excludes STRs from neighborhoods where vast majority of residents oppose them
      • Does not ban hundreds of responsible short term rental owners with no complaints
      • Focuses visitors on Arlington’s community businesses boosting local economy
      • Greatly increases revenues from Hotel and Occupancy Taxes
